Welcome to Fluxin.ai . These Terms of Service (“Terms”) govern your access to and use of Fluxin.ai ’s services, applications, integrations, and products (collectively, the Service). By accessing or using the Service you agree to be bound by these Terms.

1 Definitions

1.1 Fluxin.ai means the Fluxin.ai legal entity providing the Service as identified in your Order Form or account.

1.2 You means the person or entity that registers for or uses the Service.

1.3 User Content means content you upload, create, publish, or otherwise provide through the Service.

1.4 Privacy Policy means Fluxin.ai ’s Privacy Policy.

1.5 DPA means the Data Processing Addendum referenced in these Terms.

2 Use of the Service

2.1 Eligibility — You must be at least 18 years old to use the Service.

2.2 Account Registration and Security — You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify Fluxin.ai immediately of unauthorized access.

2.3 Acceptable Use — You will not use the Service for unlawful, abusive, or prohibited purposes, including attempts to access systems without authorization, interfering with the Service, or violating applicable laws or third‑party policies. Fluxin.ai may suspend or restrict access for violations.

3 User Content and Integrations

3.1 Ownership — You retain ownership of your User Content.

3.2 License to Fluxin.ai — By providing User Content you grant Fluxin.ai a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, and display User Content as reasonably necessary to provide, maintain, and improve the Service and integrations.

3.3 Prohibited Content — You will not upload content that is illegal, infringing, abusive, misleading, discriminatory, or violates third‑party platform rules. Fluxin.ai may remove content that violates these Terms.

3.4 Third‑Party Integrations — If you connect third‑party accounts such as Facebook, Instagram, LinkedIn, X, or Google, you authorize Fluxin.ai to access and manage data permitted by those platforms’ APIs. You remain responsible for complying with those platforms’ terms and policies. Fluxin.ai is not responsible for third‑party platform enforcement, approvals, or removals.

4 Advertising Platform Compliance

4.1 Prohibition on Political Advertising — You may not use the Service to create, manage, publish, or distribute political advertising, political content intended to influence civic engagement, or any content that would be classified as political advertising by Google, Meta, or other advertising platforms.

4.2 Prohibition on Discriminatory or Restricted Targeting — You may not use the Service to create or manage ads that employ discriminatory targeting, including targeting based on protected characteristics, or to place ads in restricted categories in ways that violate platform rules or applicable law.

4.3 User Responsibility for Ad Compliance — You are solely responsible for ensuring that any advertising content and targeting you create or publish through the Service complies with the advertising policies of the relevant platforms, applicable laws, and industry rules.

4.4 Platform Enforcement and Fluxin.ai Liability — Platform decisions such as approvals, rejections, or account actions are made by the platform and are outside Fluxin.ai ’s control. Fluxin.ai is not liable for ad rejections, account suspensions, or enforcement actions taken by third‑party platforms.

4.5 Right to Suspend for Ad Policy Violations — Fluxin.ai may suspend or terminate accounts that create, publish, or attempt to publish ads that violate platform policies, these Terms, or applicable law. Fluxin.ai may also block specific integrations or API access to protect its platform standing.

5 Billing Subscriptions Cancellation and Refunds

5.1 Subscription Billing — Paid features require a subscription. By subscribing you authorize Fluxin.ai or its payment processor to charge your selected payment method on a recurring basis.

5.2 How to Cancel — Cancel subscriptions through your account Billing settings. Cancellations must be initiated by the account owner or an authorized administrator.

5.3 Effective Date of Cancellation — Cancellation takes effect at the end of your current billing cycle unless otherwise stated at purchase. You retain access until that date.

5.4 Refunds — Fluxin.ai does not provide refunds for partial billing periods, unused time, or unused credits except for duplicate charges, verified billing errors, or where required by law. Exceptions are at Fluxin.ai ’s discretion.

5.5 Data Retention After Cancellation — Fluxin.ai retains your workspace and User Content for 30 days after cancellation to allow recovery. After 30 days Fluxin.ai may permanently delete data. Contractual exceptions may be documented in the DPA.

5.6 Reactivation — Reactivation within the retention period restores your account and content. After permanent deletion, content cannot be recovered.

5.7 Termination by Fluxin.ai — Fluxin.ai may suspend or terminate accounts for policy violations, fraud, non‑payment, security risks, or other legitimate business reasons. Termination for cause may be immediate and without refund.

6 Privacy Data Protection and Jurisdiction Compliance

6.1 High‑Level Commitment — Fluxin.ai processes personal data in accordance with applicable data protection laws. These Terms provide a high‑level summary only.

6.2 Reference to Privacy Policy and DPA — The Privacy Policy and DPA contain the operative, jurisdiction‑specific details about data transfers, lawful bases, data subject rights, retention schedules, security measures, and controller/processor roles. Rely on those documents for full details.

6.3 UK EU US Summaries — Fluxin.ai complies with the UK GDPR, EU GDPR, and applicable US laws. Cross‑border transfers are governed by adequacy decisions, recognized transfer frameworks, Standard Contractual Clauses, or other lawful safeguards as described in the Privacy Policy and DPA.

6.4 No Duplication — These Terms do not restate the full technical or legal privacy details to avoid duplication. For operational privacy obligations, data subject requests, and transfer mechanisms, see the Privacy Policy and DPA.

7 Tracking Technologies and Cookies

7.1 Use of Tracking Technologies — Fluxin.ai and its service providers use cookies, web beacons, pixels, SDKs, local storage, and similar technologies (“Tracking Technologies”) to operate and improve the Service, provide security and authentication, measure and analyze usage, and deliver features and integrations.

7.2 Consent and Controls — By using the Service you consent to the use of Tracking Technologies as described in our Privacy Policy. You may manage or withdraw consent and control certain Tracking Technologies via your account settings, cookie controls, or your browser/device settings.

7.3 Third Parties — Third parties (including analytics and advertising partners) may place Tracking Technologies when you use integrations or visit pages that include third‑party content. Fluxin.ai is not responsible for third‑party cookie practices; see the Privacy Policy for details.

8 Intellectual Property

8.1 Fluxin.ai IP — Fluxin.ai and its licensors retain all rights, title, and interest in the Service, including software, interfaces, and branding.

8.2 Trademarks — You may not use Fluxin.ai trademarks without prior written permission.

9 Communications

9.1 SMS and Authentication — By creating an account you consent to receive SMS messages for authentication and security. Standard message and data rates may apply. Opt out by replying STOP. For help reply HELP or contact support@fluxin.ai.

9.2 Email and Notices — Fluxin.ai may send notices to the email associated with your account. Official notices and billing communications will be sent to the account email unless otherwise specified.

10 Warranty Disclaimer and Limitation of Liability

10.1 Disclaimer — The Service is provided “as is” without warranties of any kind.

10.2 Limitation of Liability — To the maximum extent permitted by law, Fluxin.ai is not liable for indirect, incidental, consequential, special, or punitive damages. Liability for direct damages is limited to the amount paid by you to Fluxin.ai in the 12 months preceding the claim, except where prohibited by law.

11 Changes to the Terms

11.1 Modifications — Fluxin.ai may update these Terms. Updates become effective upon posting. Continued use after posting constitutes acceptance.

12 Governing Law and Consumer Protections

12.1 Governing Law — These Terms are governed by the laws of the jurisdiction in which the applicable Fluxin.ai legal entity operates, without regard to conflict‑of‑law principles.

12.2 Consumer Protections — Where mandatory consumer protections apply in your jurisdiction, those protections govern to the extent required by law.
